Terms of Service

Effective date: May 25, 2026

1. Agreement

By accessing or using Recourse ("the Software"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software. These Terms constitute a legally binding agreement between you ("User") and Recourse.

2. License

Recourse grants you a non-exclusive, non-transferable, limited license to use the Software for your internal business operations as a licensed mortgage professional.

You may not:

  • Sublicense, sell, resell, transfer, or assign the Software to any third party
  • Modify, translate, adapt, or create derivative works of the Software
  • Reverse engineer, disassemble, or decompile the Software
  • Use the Software to build a competing product or service
  • Use the Software for any unlawful purpose or in violation of any applicable law

3. Permitted Users

Access to the Software is restricted to authorized accounts. You are responsible for maintaining the confidentiality of your PIN and for all activity that occurs under your account. You agree to immediately notify us of any unauthorized use of your account.

4. Your Responsibilities

You are solely responsible for:

  • All data you enter into the Software, including client contact information and loan details
  • Compliance with all applicable laws, including the Gramm-Leach-Bliley Act (GLBA), the Real Estate Settlement Procedures Act (RESPA), the Fair Credit Reporting Act (FCRA), and applicable state mortgage licensing laws
  • Obtaining any required consents from your clients before sending them communications through the Software
  • Compliance with the Telephone Consumer Protection Act (TCPA) before sending SMS messages
  • Your GoHighLevel account usage and compliance with GoHighLevel's terms

5. Compliance Obligations

This Software is a tool — it does not make you compliant. You remain responsible for your own regulatory compliance as a mortgage professional, including:

  • GLBA Safeguards Rule: Maintaining a written information security program for your firm
  • TCPA: Obtaining prior express written consent before sending marketing SMS messages
  • CAN-SPAM: Including required disclosures and opt-out mechanisms in commercial emails
  • State licensing: Operating only within your licensed jurisdiction

6. AI-Generated Content

The Software uses artificial intelligence (via Anthropic's Claude API) to generate lead scores, summaries, and outreach message drafts. AI-generated content:

  • May contain errors and should not be relied upon without human review
  • Does not constitute legal, financial, or professional advice
  • Is your responsibility to review before sending to any client or prospect

7. Data Ownership

You retain full ownership of all data you enter into the Software. Recourse does not claim any rights to your client data. Your data is stored locally on your device and we do not have access to it.

By using AI features, you grant Anthropic permission to process that data according to their terms. By using GHL integration features, you grant GoHighLevel permission to process that data according to their terms.

8. Disclaimer of Warranties

The software is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be error-free, uninterrupted, or free of security vulnerabilities.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Recourse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, loss of goodwill, service interruption, computer damage, or the cost of substitute services, arising from your use of the software. Our total liability for any claim shall not exceed the amount you paid for the software in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Recourse and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Software; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content you submit through the Software.

11. Termination

We may terminate or suspend your access to the Software immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Software ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in California.

13. Changes

We reserve the right to modify these Terms at any time. We will notify active users of material changes via the app. Continued use after the effective date of changes constitutes your acceptance of the new Terms.
